PFL vs FMLA - A Comparison
The similarities and differences between New York Paid Family Leave and the Family & Medical Leave Act
The Family and Medical Leave Act (FMLA) is an unpaid federal program that provides job security during an employee's approved family /
medical-related leave for up to 12 weeks. FMLA does not provide a monetary benefit whereas Paid Family Leave (PFL) does.
Both Paid Family Leave and FMLA offer job protection.

All private sector New York businesses with at least one employee (not counting the owner) must offer Paid Family Leave. The Family &
Medical Leave Act applies to all businesses with more than 50 employees.
Eligibility is different for Paid Family Leave (PFL) compared to FMLA
FMLA requires the employee has worked for their employer for a minimum of 12 months and have worked for at least 1,250 hours in the 12
months immediatley before the leave. They also must work at a location where at least 50 employees are employed by the employer within
75 miles.
Paid Family Leave (PFL) requires that the employee has worked for their employer for 26 weeks before becoming eligible to have a leave.
It's 175 days if the employee works part-time.
